1      General terms and conditions of use for the ANTS.GOUV.FR websites

1.1     Purpose

These general terms and conditions of use (hereafter, the "Terms of Use") are intended to govern the access to and the use of the following sites:

They apply to any access to, use of or consultation of the Portal by a user.

The Portal is free to use, and its aim is to enable users to find out more about the Agence Nationale des Titres Sécurisés (the ANTS) (French National Agency for Secure Documents) and its services, and to initiate online vehicle registration, passport, national identity card and driving licence procedures.

In the online area, reviewing the Terms of Use is an essential prerequisite for creating an account. This obligation is reflected by the box "I have read the Terms of Use". In order to continue and create an account, the user must check this box. The user thus expressly acknowledges that he/she has reviewed these Terms of Use.

These Terms of Use may be amended at any time, without prior notice, depending on the changes made to the Portal, changes in legislation or for any other reason deemed necessary.

The amendments will then come into force as from the date of their publication on the Portal, or from any other date that may be indicated. By simply accessing the Portal, all users are considered to have acknowledged the new version of the Terms of Use on the Portal.

It is the responsibility of the Portal user to consult the Terms of Use regularly.

 

1.2     Description of the Portal

allow all Internet users to learn more about:

-          the missions of the ANTS,

-          the administrative formalities offered by the ANTS (description of the online procedures, list of the supporting documents, frequently asked questions about the procedures, etc.),

-          news about the various secure documents (vehicle registration certificate, driving licence, passport, national identity card) posted online by the agency,

and:

-          to contact the ANTS with regard to their account and/or their online procedures using the contact forms,

-          to geolocate automotive professionals authorised to use the vehicle registration system (SIV), photographers authorised to produce a digital photo-signature and municipal offices with a collection system for biometric passport and national identity card (CNI) applications,

-          to access certain online services (remote access points, Justif'Adresse, electronic tax stamps, driving licence results, downloading CERFA forms, etc).

The site moncompte.ants.gouv.fr allows all individuals and legal entities registered with the French National Institute for Statistics and Economic Studies (the INSEE), automotive professionals authorised to use the vehicle registration system (SIV), driving schools and road safety training centres (CSSR) to access the online administrative procedures provided by the Portal and to consult information dedicated to them. This site allows municipal offices having a fingerprint scanner to access the specialised documentation.

 

Use of geolocation

The sites listed above allow for geolocation of:

-          photographers or photo booths authorised to produce a digital photo signature;

-          the automotive professionals authorised to carry out vehicle registration formalities;

-          the municipal offices equipped with a fingerprint scanner.

 

Information concerning the geolocation of the automotive professionals authorised to use the vehicle registration system (SIV), photographers and municipal offices is updated regularly.

The information concerning the automotive professionals authorised for the SIV is provided by the application for the vehicle registration system (the SIV). The information concerning the photographers and the photo booths is provided by the photography agencies and the booths. The information concerning the municipal offices is provided by an internal service of the agency.

Despite the care taken in publishing this geolocation data, the ANTS cannot guarantee the accuracy and completeness of the information provided.

In the mobile version, users can activate their phone's geolocation in order to identify a professional, a municipal office or a photographer/photo booth authorised to produce a digital photo signature in their area. This does not involve any retention of the user's data by the ANTS or its data processors.

 

1.3     Method of access

The informational sites are free to consult and require access to the Internet. Access to the personal area of the site moncompte.ants.gouv.fr requires you to be identified by means of FranceConnect or an ANTS account.

In the framework of an obligation of means, the ANTS undertakes to ensure the availability and accessibility of the Portal, 24 hours a day, 7 days a week. Nonetheless, the ANTS may carry out tests, checks and/or maintenance operations, as well as any necessary interventions in the event of a breakdown or security alert, at any time. To the extent possible, the ANTS endeavours to inform users when such an operation takes place by means of an announcement on the Portal. The ANTS cannot be held responsible for any direct or indirect consequences that may result for any user.

It is the responsibility of all users to ensure that they have the appropriate IT and electronic communications equipment to access the Portal and to take all appropriate measures to protect their data, documents of any kind and software stored on, coming from or directed to their IT equipment or any other computer terminal against any attack or damage.

If the user does not possess the equipment needed to carry out his/her online formalities using the sites of the ANTS, he/she may find assistance in performing these formalities at the digital assistance points located throughout France (https://www.demarches.interieur.gouv.fr/points-numeriques). This service is an initiative of the Ministry of the Interior and is not subject to the responsibility of the ANTS.

All users acknowledge that they are familiar with and understand the Internet, electronic communication networks and their limitations and, in particular, their functional characteristics and technical performance, the risks of interruption, response times for consulting, querying or transferring information, and the risks, of whatever nature, inherent in any data transfer, particularly on an open network.

 

1.4     Modification and development of the ANTS Portal

The ANTS reserves the right to ensure the development of, to modify or suspend, without advance warning, the functionalities and the editorial content of the sites listed above for reasons of maintenance or for any other reason deemed necessary. An information page is then displayed to the user that states the unavailability of the site.

The unavailability of sites does not create any right to compensation.

 

1.5     Creating a user account

To access the services of the online area on the Portal, users must be authenticated by creating an account. The requirements for creating an account depend on the profile of the user.

Below is a list of the various user profiles

1.       Individuals,

2.       Automotive professionals authorised to use the SIV,

3.       Driving schools,

4.       Road safety training centres (CSSR),

5.       Municipal offices equipped with a fingerprint scanner,

6.       Legal entities (any professionals other than those cited above).

 

For individuals, creating an account requires:

  • Having an e-mail address that is accessible,
  • Creating an ANTS or FranceConnect account,

a.       If you do not have a FranceConnect account:

                                            i.     Create your account by completing the form for creating an account,

                                           ii.     Activate your account by clicking on the link sent to the e-mail address you provide,

                                          iii.     Once the account is activated, the user can be authenticated and you can access your formalities online.

b.       If you have a FranceConnect account:

                                            i.     Authentication is done through an account existing on one of the services using FranceConnect (impots.gouv.fr, MSA et moi, Ameli.fr, Identité numérique de la Poste (digital identity of the Post), Mobile connect et moi). Depending on changes to the FranceConnect service, the Ministry of the Interior may modify this list. 

                                           ii.     Once this authentication is completed, the user will be redirected to access the online services.

For professionals authorised to use the SIV, creating an account requires:

  • Having been authorised by the prefecture of the department where they do business.
  • Having a valid and accessible e-mail address in order to receive the procedure for connection to their ANTS account, after validation by the prefecture. It is thus essential to have an accessible e-mail address.

For driving schools, creating an account requires:

  • Having an e-mail address that is accessible,
  • Having an approval number,
  • Completing the form for creating an account on the Portal.
  • Activate your account by clicking on the link sent to the e-mail address you provide,

For the Road safety training centres, creating an account requires:

  • Having an e-mail address that is accessible,
  • Having an approval number,
  • Completing the form for creating an account on the Portal,
  • Activate your account by clicking on the link sent to the e-mail address you provide,

For municipal offices equipped with a fingerprint scanner, creating an account requires:

  • Having one or more DRs (fingerprint scanners) in order to complete requests for passports or national identity cards,
  • Requesting the ANTS to create an account by means of the contact form,
  • Transmitting to the ANTS an accessible e-mail address at the time of requesting to create an account.

For legal entities, creating an account requires:

  • Having an e-mail address that is accessible,
  • Having a SIRET number,
  • Completing the form for creating an account on the Portal,
  • Activate your account by clicking on the link sent to the e-mail address you provide,

 

1.6     Use of the service

The Portal allows users to access online services to request vehicle registration, driving licences, pre-requests for national identity cards and passports. It is necessary to have an active account and to be authenticated in order to initiate the procedures. The terms for creating and activating an account vary depending on the type of users:

In order to initiate a request,

1.       The user clicks on the "New Request" button and

2.       The user then chooses the type of procedure desired: Vehicle registration, driving licence, identity card and passport

3.       The user then selects the desired online procedure and is redirected to the corresponding system.

 

For users who do not wish to or cannot use the FranceConnect system for vehicle registration procedures, it is possible to rely on the help of a trusted third party who has an active FranceConnect account or to rely on an authorised automotive professional.

 

1.7     Costs involved in the service

The Service is free of charge. All the costs and expenses for equipment, communication charges and other charges necessary for connection and access to the Portal and the use of the Portal, as well as any necessary or related authorisation charges, are and remain the responsibility of the user.

 

1.8     Security and confidentiality of the Portal

The ANTS undertakes to take all useful precautions in order to preserve the security of the data collected from the user, and in particular to prevent them from being distorted, damaged or accessed by unauthorised third parties.

The ANTS reserves the right to suspend access to the sites for the duration of any planned intervention if it considers that an event likely to affect the operation or integrity of the sites requires this, or in the event of maintenance. In this event, as soon as it is aware of the dates of the scheduled interventions, the ANTS undertakes to inform users as soon as possible on the Portal's homepage or by any other means at its convenience, and to reduce the period of unavailability during the day. However, the ANTS cannot be held responsible for this suspension and will not be subject to any compensation.

 

1.9     Intellectual property rights

1.9.1       Graphic creations, photo and video credits on the Portal

The Portal is protected by French legislation and in particular by the law on intellectual property.

Pursuant to Article L.122-4 of the French Intellectual Property Code, "Any representation or reproduction in whole or in part without the consent of the author [here, the ANTS] is unlawful (…)", regardless of the process used.

This protection applies to the general structure of the site, its content - with the exception of official documents (see Chapter 1.9.3 of the Terms of Use) - its logos and visuals, the graphic creations, photographic credits, videos and databases extracted, copied or made from the content of the Portal, whether or not by automated means.

Consequently, any full or partial reproduction of this site or any of its component parts is strictly prohibited.

The ANTS reserves the right to seek damages in the event of infringement of its intellectual property rights, and reserves the right to file a complaint for counterfeiting in the event of fraudulent use or reproduction of the sites and their component parts.

 

1.9.2       The implementation of links to the sites

The creation of links to the sites: www.ants.gouv.fr, www.immatriculation.ants.gouv.fr, www.permisdeconduire.ants.gouv.fr, www.passeport.ants.gouv.fr, www.pha.ants.gouv.fr, www.autoecole.ants.gouv.fr, www.mairie.ants.gouv.fr, moncompte.ants.gouv.fr is not subject to any prior agreements.  Links to the sites of the ANTS may be made freely, provided that:

·         the page opens in a new window,

·         this does not point to sub-pages of the ANTS site (thus this authorisation excludes direct links to downloadable files such as pdf documents, images, videos, etc.),

·         the "title" of the link cites the name of the agency.

 However, the ANTS reserves the right to request the removal of any links by third-party sites in the event of:

·          Non-conformity with the objective of the ANTS;

·         Dissemination of information on these sites of a nature that is racist, pornographic, xenophobic or any material that may offend the sensibilities of the public;

·         Dissemination of information by these sites that is illegal.

 

1.9.3       Use of official documents

In accordance with Article L122-5 of the French Intellectual Property Code, "official documents" may be freely re-used, particularly for educational purposes, subject to the following conditions:

·         They are not re-used for commercial, promotional or advertising purposes;

·         The integrity of the information reproduced is respected, so as not to alter the meaning, scope or application of the information;

·         It is stated that the reproduction rights are reserved and strictly limited;

·         The source (the ANTS), the origin (the ANTS website) and the date of publication are stated. 

·         This authorisation does not apply to sites that disseminate:

o   Information that is contrary to the goal and the objective of the ANTS;

o   Content of a nature that is racist, pornographic, xenophobic or any material that may offend the sensibilities of the public;

o   Content of any sort that is illegal by nature.

The creation of a product or service intended to be made available to third parties, whether free of charge or in return for payment, is considered to be re-used for commercial or promotional purposes when created by using public information.

The use of trademarks or iconography used on this site in any other medium or network is strictly prohibited.

 

1.9.4 The trademarks

The ANTS is a trademark registered with the Institution Nationale de Propriété Industrielle (the French National Industrial Property Office). Any use, reproduction or imitation of the ANTS trademark in such a way as to mislead any user constitutes, in the absence of authorisation from ANTS, an infringement liable to civil proceedings under Article L.716-4 of the French Intellectual Property Code, and may result in a claim for damages. 

1.9.5 Social media buttons

Certain pages on these sites contain external links to social media networks and provide access to functions for sharing content on the various social media platforms. Internet users are responsible for their use of this and for the content published using these tools.

 

1.9.6 Warnings

Despite all the care taken by our editorial and technical teams in drafting and putting documents online, typographical errors or technical inaccuracies cannot be ruled out. The ANTS reserves the right to correct these at any time as soon as they are brought to its attention.
The information and the documents contained on the sites www.ants.gouv.fr, www.immatriculation.ants.gouv.fr, www.pha.ants.gouv.fr , www.permisdeconduire.ants.gouv.fr, www.autoecole.ants.gouv.fr, www.passeport.ants.gouv.fr, www.mairie.ants.gouv.fr, www.moncompte.ants.gouv.fr may be updated at any time. In particular, they may have been updated between the time that they were uploaded and the moment when the user reviews them.

 

Links to other public or private sites may be offered on the sites www.ants.gouv.fr, www.immatriculation.ants.gouv.fr, www.pha.ants.gouv.fr, www.permisdeconduire.ants.gouv.fr, www.autoecole.ants.gouv.fr, www.passeport.ants.gouv.fr, www.mairie.ants.gouv.fr, moncompte.ans.gouv.fr, in order to facilitate the user's access to information.

The ANTS has no responsibility with regard to the content of these sites. 

 

1.10  Responsibilities

1.10.1     Responsibility of the ANTS

The ANTS does not grant any guaranty concerning the ability of the Portal to meet the particular needs or expectations of any user.

 

Similarly, the ANTS cannot guarantee that no errors or other malfunctions will occur when using the Portal.

 

Similarly, the ANTS declines all responsibility with regard to any use of the Portal by any user that does not comply with these Terms of Use.

The ANTS's responsibility is limited to the verification of personal identification data.

Under no circumstances will the ANTS be responsible for any damages such as, but not limited to: financial or commercial loss, loss of customers, any commercial disruption whatsoever, loss of profits, loss of brand image, loss of computer programs suffered by the user that may result from the failure to execute these Terms of Use; such damages are, by express agreement, deemed to be indirect damages.

 The ANTS is not responsible for the unavailability of the (software or hardware) networks that are not entirely under its direct control, or for any modification, suspension or interruption of the Portal, as well as the continuity, durability, compliance, compatibility or performance of such networks or the absence of bugs.

Moreover, the ANTS does not assume any commitment or responsibility:

·         with regard to the use of the Portal by the user that is not in accordance with the regulations in force regarding the protection of software;

·         with regard to the normal wear and tear of the computer equipment of the user, or damage to information on such equipment due to the influence of magnetic fields.

 

1.10.2     Responsibility of the user

The user uses the service solely under his/her entire responsibility. The user acknowledges that he/she may be held liable, particularly in the case of fraudulent use of the service. The user undertakes to use the service in accordance with these Terms of Use and the regulations in force.

 

The user is responsible for the use of his/her personal identification data.

The user acknowledges that the services offered to the profiles for individuals are solely for personal use and that any use of such services is made under the user's full and entire responsibility. The services offered to the professional profiles are solely for professional use and must not be used for personal purposes. Moreover, all users acknowledge that the authentication data are intended to be personal and may not be transmitted to anyone, at the risk of incurring personal responsibility.

 The user is solely responsible for the consequences of a failure to update his/her personal identification data. In the event that the information provided is inaccurate, incomplete or obsolete, the user will be solely responsible for any defects in the vehicle registration procedures, pre-applications for driving licences, national identity cards or passports.

The user is responsible for any damage caused by him/her to the ANTS. The user undertakes to indemnify the ANTS, in the event of any request, claim or order for damages, to which the ANTS may be subject as a result of non-compliance with these stipulations or damage caused to others or to the user.

The user shall indemnify the ANTS against any claim, pretention or demand by third parties alleging an infringement of their rights as a result of the user's use of the portal or as a result of the measures taken by the ANTS to cease the infringement of the rights of third parties.

Each user undertakes not to modify, attempt to modify or harm the websites in any way whatsoever and not to use any software or any form of computer program with the aim of reaching or making available content that is protected or not freely available. It is also forbidden to create a work, an application or a site derived from all or part of this Portal.

The user undertakes to inform ANTS immediately, by any means, of any error, fault or irregularity that he/she becomes aware of when using the Portal.

Users remain solely responsible for any data or documents stored on their terminal.

Users are reminded that any person making a false declaration on his or her own behalf or on behalf of another person is liable to the penalties provided for in Article 441-1 of the French Criminal Code, which provides for penalties of up to three years' imprisonment and a fine of 45,000 euros.

The user undertakes to provide only accurate, up-to-date and complete information when using the Portal. If the user fails to comply with this commitment, the ANTS reserves the right to suspend or terminate the administrative procedure, without prejudice to any criminal and civil liability claims that may be brought against the user.

 

1.10.3     Force Majeure

The ANTS shall not be held liable for any delay in the performance of its obligations or for any non-performance of its obligations resulting from these Terms of Use when the circumstances resulting in this are subject to an event of force majeure, which is defined as any unforeseeable, irresistible and external event.

The following are expressly considered to be cases of force majeure or fortuitous event, in addition to those usually accepted by the case law of French courts and tribunals, and the contractual clauses contained in these Terms of Use:

Complete or partial strike, lock-out, riot, civil unrest, insurrection, civil or foreign war, nuclear risk, embargo, confiscation, capture or destruction by any public authority, bad weather, epidemic, blockage of means of transport or supply for any reason whatsoever, earthquake, fire, storm, flood, water damage, governmental or legal restrictions, legal or regulatory changes to marketing methods, blockages of electronic communications, including electronic communications networks, which cannot be foreseen by the ANTS, and which call into question the norms and standards of its profession and any other event beyond the control of the parties which prevent the normal performance of the obligations arising from these Terms of Use.

Any case of force majeure that affects the performance of the obligations resulting from these Terms of Use and in particular access to or use of the service by the user will suspend the performance of these Terms of Use as of the date that this occurs. As from this date, and despite the case of force majeure, the ANTS will endeavour to the extent possible:

·         to inform users of the existence of this case of force majeure;

·         to implement any other technical solution enabling users to initiate their applications for vehicle registration, driving licence or identity documents.

The exceptional implementation of these palliative measures by the ANTS during the occurrence of a case of force majeure shall not result in any liability or compensation on the part of the ANTS.

 

1.11     Suspension – deletion

1.11.1     Temporary suspension and reactivation of access to the account at the initiative of the ANTS

The ANTS reserves the right to temporarily suspend access by the user to the account for reasons relating to the security of the Portal, the security of the user or a breach or suspected breach by the user of one of the obligations as set out in these Terms of Use.

 

In the event of temporary suspension, an e-mail will be sent informing the user of the reason for and duration of the suspension. These Terms of Use remain in force during and after the suspension of the account.

 

If the breaches or suspected breaches are unfounded, access may be reactivated.

 

This suspension will take place automatically, without the user being able to claim any damages whatsoever.

 

1.11.2     Deletion of access to the account at the initiative of the ANTS

The ANTS also reserves the right of deletion if the user proves to be in serious and/or repeated breach of any of the obligations set out in these Terms of Use or in the event that the ANTS definitively ceases to use the Portal. In the latter case, the deletion will be effective after notification of the end of the service.

 

This deletion will take place automatically in the event of serious and/or repeated breaches of any of the user's obligations set out in these Terms of Use, without prejudice to any damages that the ANTS may seek.

 

The ANTS reserves the unilateral right to temporarily or permanently refuse access to the portal to any user who does not comply with these Terms of Use or in the event of proven or suspected compromise of the account. The ANTS reserves the right to keep evidence of any breaches observed by archiving them for the time required to resolve the dispute.

 

This deletion will be carried out automatically, without the user being able to claim any damages.

 

1.11.3     Deletion of the account at the initiative of the user

The user has the right to delete his/her account at any time by means of the account or by contacting the client service of the ANTS (see chapter 1.16).

 

1.11.4      Suspension and termination of accounts for authorised automotive professionals

Only automotive professionals who possess a valid authorisation can access their accounts. Authorisations are managed by the prefectures.

If your authorisation has been suspended by the prefecture, your account will be deactivated. If your authorisation is reactivated, you will be able to retrieve your account and your procedures.

If your authorisation has been terminated by the prefecture, your account and data will be deleted from our databases.

The ANTS cannot be held responsible in the event that the withdrawal of the authorisation for an authorised automotive professional results in the loss of access to the Portal and has an impact on the professional's business activities.

 

1.12  Sub-contracting

The ANTS reserves the right to have all or part of the services covered by these Terms of Use performed by any sub-contracting company of its choice, with the ANTS remaining solely liable to the user, and being responsible for taking action against its sub-contractors.

 

1.13  No waiver of rights

The fact that the user and/or the ANTS does not take advantage of a breach by the defaulting party of any of the obligations resulting from the Terms of Use shall not be interpreted as a waiver of the obligation in question.

 

1.14   Permanence

The invalidity of any clause of the Terms of Use shall not affect the validity of the other clauses; they shall continue in the absence of the invalidated provision unless the invalidated clause renders the continuation of the contractual relationship impossible or imbalanced as compared to the initial contractual relationship.

 

1.15   Information

Any request for information concerning the Portal may be addressed to the ANTS:

The ANTS undertakes to respond to all requests for information within a period of fifteen (15) working days.

 

1.16   Claims

In order to avoid any late claims, and in particular to enable the ANTS to preserve all evidence, the user must notify the ANTS that he/she intends to hold it liable.

This notification must precisely indicate the errors, shortcomings or delays observed and must be sent at the latest within thirty (30) days following the occurrence of the event for which the ANTS may be held liable.

 

Any complaint concerning the sites and/or the service must be addressed to the ANTS:

·         by registered letter with proof of delivery: ANTS, 18 rue Irénée Carré, BP 70474, 08101 Charleville-Mézières.

 

The ANTS undertakes to take into account claims by any users within sixty (60) days following receipt at the address indicated above and to assess the legal consequences to be given to this claim.

 

1.17  Agreement on proof

In connection with the services, the ANTS and the user agree to establish rules relating to the proof admissible between them in the event of a dispute and its probative force. The following provisions thus constitute the agreement on proof between the parties, who undertake to comply with this article.

 

The parties agree that, in the event of a dispute, the accounts and confidential security codes used as part of the service will be admissible in court and will constitute proof of the data and facts they contain, as well as the means of identification and the authentication procedures that they represent.

 

The parties accept that, in the event of a dispute, the event logs and connection data relating to actions performed from their accounts are admissible in court and constitute proof of the data and facts they contain.

 

1.18  Headings of the clauses

The headings given for each article only serve to facilitate reading and may not in any event be considered to be a pretext for any interpretation or distortion of the clauses to which they relate. In the event of a difficulty of interpretation or any contradiction between the content of a clause and its title, the title shall be considered not to exist.

 

The parties expressly agree that the language governing these Terms of Use is the French language. In the event of a contradiction between these Terms of Use and a translation of the same Terms of Use, the French language Terms of Use shall prevail over any translations into foreign languages.

 

1.19  Alternative settlement of disputes before referring to the courts

In the event of a dispute relating to the interpretation, formulation or performance of the Terms of Use between the parties, the parties undertake, prior to any referral to the courts, to cooperate diligently and in good faith in order to resolve the dispute rapidly and amicably.

 

In the event of a dispute, the user must contact the ANTS by sending a registered letter with acknowledgement of receipt.

 

Within two months after receiving the registered letter, the ANTS will send a written response to the user. The absence of a response from the ANTS within this period of two months shall constitute a rejection.

 

The user has the possibility to respond within two months after receiving the response from the ANTS.

 

1.20  Competent jurisdiction and applicable law

In the absence of an amicable resolution of the dispute, the parties hereby give express and exclusive jurisdiction to the competent French courts, notwithstanding a plurality of defendants or actions for summary proceedings or third-party claims or protective measures, in matters of interpretation, challenges or claims concerning the Portal.

 

The Portal is subject to French law. All of its content, offers and services are governed by French regulations currently in force.

If any provision of these Terms of Use is held to be invalid or declared as such in application of a law, regulation or following a final decision by a competent court, the other provisions shall nevertheless remain in force.
